An Iowa City woman accused in the death of her 20-month-old son is negotiating a plea deal and won’t likely go to trial, according to her attorney.
Mireya Balderas, 20, is charged with child endangerment resulting in death after her son, Marcus Balderas, died of blunt force injuries to the head on April 30, 2012.
Balderas's boyfriend, Jorge Perez, faces two counts of child endangerment resulting in death in connection with what investigators call a series of assaults that they believe led to the toddler's death.
Balderas's charge stems from accusations that she participated in the abuse and failed to protect her child from Perez.
Balderas was scheduled to go to trial Dec. 10 in Johnson County District Court, but attorneys agreed the case should be delayed, according to a motion filed by Balderas’s attorney Nov. 26.
“It appears that the case will be disposed of without a trial, but the details of the plea agreement remain to be worked out,” Mark Meyer wrote.
Assistant Johnson County Attorney Dana Christiansen was not available Thursday to confirm the likely plea deal.
Balderas’s trial is set for April 23. She has been living with her father since February.Perez, who posted bond Nov. 7, is scheduled for trial March 4.
