Former State Rep. Kerry Burt receives deferred sentence for enrolling kids at Price Lab under false address

WATERLOO – A former state representative has been given a deferred judgment for allegedly using another person's address to enroll his children at Malcolm Price Lab School.
The sentence means no jail time for Kerry Lynn Burt.
Judge Richard Stochl handed down the sentence against Burt, 46, in Black Hawk County District Court Tuesday. He received one to two years of self-probation and the charge will come off his record if he successfully completes probation.
He faced a maximum of eight years in prison – two years for each of four counts.
Burt's attorney, Ray Walton asked for a new trial but when that wasn't granted he requested a deferred judgment that would have removed the charge from Burt's criminal record.
A jury found Burt guilty of four counts of misdemeanor tampering with records following an April trial.
Assistant Iowa Attorney General Scott Brown said Burt, a Waterloo resident, used an acquaintance's Cedar Falls address to register his children at Price Lab, which is located in Cedar Falls and is part of the University of Northern Iowa.
Burt didn't deny using the address, but he said Dave Smith, and former principal and director at the school, gave him permission.
Burt was the last parent to go to trial on the allegations. Other defendants were granted deferred judgments with self probation.
